Answers To The Questions You Have About Personal Injuries

The aftermath of a personal injury can feel overwhelming and confusing. At Mayer Law Office in Dexter, we understand that you probably have a lot of questions that you need to ask a lawyer. Fortunately, our founding attorney, Dustin Mayer, has the extensive knowledge and experience to help you. On this page, we have taken the time to answer a few of the questions that our clients ask us most frequently.

Do I have a case?

If you want to file a personal injury lawsuit, you need to prove that the other party involved owed you a certain duty of care and that they breached that duty. Then, you must show that you have damages resulting from their breach of duty. For example, a driver failed to obey the traffic laws, resulting in a car crash and an injury.

What should I say to my insurance company?

Do not speak with any insurance providers until you have a lawyer. The insurance company does not want to pay your claim; it wants to make as much money as possible. Insurance representatives have tricks to get you to admit fault or sound as if your injuries are not severe so they can offer you a lower settlement than you need.

Will I need to file a lawsuit?

The vast majority of personal injuries do not go to court. If you have a skilled personal injury attorney on your side, insurance companies will usually negotiate a fair settlement rather than spend money on a trial. However, if they refuse to pay the compensation you deserve, a lawsuit might be necessary.

Is there a statute of limitations?

In Missouri, the statute of limitations for filing a personal injury claim is five years from the date of your accident. The statute of limitations for filing a wrongful death claim, however, is only three years from the date of your accident. If you miss the deadline, you lose your right to seek compensation.

Do I really need to hire a lawyer?

You have every right to handle your claim on your own. However, the law is immensely complex. Having an attorney ensures that someone can explain the process to you, protect your rights and make sure you receive a fair offer.
